All-Russian meeting “Legal regulation of forest relations”

On July 11, a meeting was held in Nizhny Novgorod on the legal regulation of forest relations. The event was chaired by the head of Rosleskhoz, Ivan Sovetnikov. The Russian Timber Association also took part in the meeting.

The main topic of discussion was the formation of forest areas under non-forest real estate in accordance with Article 4.7 of Federal Law No. 201-FZ of December 4, 2006.

According to the Law on Forestry Amnesty No. 280-FZ of July 29, 2017, under capital construction projects registered in the Unified State Register on forest fund lands, it is possible to create a plot with a different category of land that corresponds to the purpose of the facility. As a result of the change in the category of the site, the owner will remain the same - the Russian Federation.

Deputy Head of Rosleskhoz Vyacheslav Spirenkov emphasized the need to develop a unified approach to the issue of forming land plots for real estate on forest lands. It is important to determine the body that will approve the layout of the land plot, as well as set deadlines for approval. Practices may vary in each region at this time.

Vyacheslav Spirenkov, deputy head of Rosleskhoz: “We are productively interacting with colleagues from Rosreestr on land issues, including forest amnesty and determining the types of permitted use of forest areas. At the same time, we consider it necessary to regulate the issue related to the formation of forest areas under real estate, and in general to work out the document on the basis of which the formation of forest areas is carried out.”

Also, when developing amendments to legislation, it is necessary to reduce the time frame for reviewing and approving documents related to the formation and provision of forest plots. This will help avoid unnecessary bureaucratic delays.
